Judge Rules Enough Evidence For Thousand Oaks Man To Face Trial In Mother's Death
Tuesday September 10, 2024
Updated--A judge has ruled that there is sufficient evidence for a Thousand Oaks man accused of murdering his mother with a hammer to face trial.
The ruling came following a preliminary hearing for 22-year-old Scott Goldberg.
At one point in the case criminal proceedings were suspended after the defense attorney for Goldberg raised a doubt about his client's ability to understand the charges against him and aid in his defense.
A court-appointed psychologist determined that he can and the judge reinstated the criminal case.
Goldberg has pleaded not guilty to murdering his mother and also assault with a deadly weapon regarding his father who was injured in the same attack.
Prosecutors say the attacks happened on the night of November 19, 2023 at the family home in the 200 block of Mayfield Court in Thousand Oaks.
They allege that Goldberg first attacked his mother, 63-year-old Alison Marshall upstairs, bludgeoning her in the head.
His 64-year-old father, hearing her screams, raced upstairs only to have Goldberg turn and attack him with the hammer.
Deputies responded to the home and took Goldberg into custody without incident.
His mother was taken to Los Robles Medical Center with multiple skull fractures and a brain injury.
She was released on November 28, 2023 to hospice care where she died on December 1, 2023.
Goldberg remains in jail and is being held without bail.
He is due back in court in October to have a trial date set.
