Oxnard Man Shot By Officers Now Facing A Boatload Of Charges And Allegations

     Updated--The Oxnard man shot by officers earlier this month is out of the hospital and now facing a boatload of charges and special allegations.

     34-year-old Cesar Ayalaarteaga was in court Thursday where he pleaded not guilty to more than 20 charges and denied 156 special allegations that go on for a dozen pages.

     On the night of October 21st Oxnard officers responded to a report of shots fired from a vehicle in the 3700 block of Leeward Way just east of Victoria Avenue where they encountered Ayalaarteaga.

     They say he was holding a gun and refused repeated commands by Sergeant David McAlpine and Officer Ricardo Garcia to put the gun down as they tried to de-escalate the situation.

     Instead, according to police, Ayalaarteaga pointed the gun at the officers who then shot him.

     McAlpine, who has been with the department since 2008, and Garcia, who has been with OPD since 2022, were not injured in the incident.

     Ayalaarteaga was hospitalized at VCMC until October 29th and then released and immediately arrested on a host of charges and special allegations related to the incident and also several out of county warrants regarding burglary and battery cases.

     Ayalaarteaga, who lists his occupation as civil engineer and pipe fitter, remains in the Ventura County Jail with bail set at more than $1.1 million.
